These Terms of Service (“Terms”) govern your access to and use of the website, online store, products, content, features, and related services operated by Rizq Ventures LLC, doing business as The Modern Formula (“The Modern Formula,” “we,” “us,” or “our”).

Our online store is powered by Shopify. By visiting our website, purchasing a product, creating an account, enrolling in a subscription, or otherwise using our services, you agree to these Terms and the policies referenced in them.

If you do not agree to these Terms, you must not use our website or purchase our products.

1. Eligibility

You must be at least 18 years old and have reached the legal age of majority where you live to make a purchase through our website. If you have not reached the legal age of majority, you may use the website only with the involvement and permission of a parent or legal guardian.

By using the website or placing an order, you represent that you are legally capable of entering into a binding agreement.

You may not use our products or Services for any unlawful or unauthorized purpose.

2. Our Role and Fulfillment Partners

Rizq Ventures LLC, doing business as The Modern Formula, is the seller of the products offered through this website.

We work with independent third-party logistics providers, warehouses, fulfillment centers, payment processors, shipping carriers, and other service providers. These providers may store inventory, process payments, pack orders, ship products, provide tracking information, and perform related services on our behalf.

Our use of third-party service providers does not make The Modern Formula an intermediary or agent between you and another product seller. Your purchase agreement is with Rizq Ventures LLC unless clearly stated otherwise.

3. Products and Availability

We make reasonable efforts to present product descriptions, ingredients, images, pricing, availability, and other information accurately. However:

• Product packaging, colors, and appearance may vary slightly from website images

• Product information may be updated from time to time

• Products may be unavailable, discontinued, restricted, or limited in quantity

• We do not guarantee that all website information will always be complete, current, or error-free

We may limit the quantity of products sold to any person, household, geographic region, or jurisdiction. We may also discontinue or modify a product at any time, subject to applicable law.

Reselling our products without written authorization is prohibited.

4. Dietary Supplement and Health Disclaimer

Our products are dietary supplements and are intended to support general wellness. They are not medicines or substitutes for professional medical care.

Information provided through our website, advertisements, emails, customer support, product descriptions, articles, or other materials is for general informational purposes only. It is not intended to provide medical advice, diagnosis, or treatment.

• Payment or billing problems

• Pricing, inventory, or website errors

• Suspected resale or commercial misuse

If we cancel an order after payment has been collected, we will issue an appropriate refund to the original payment method.

You are responsible for providing accurate billing, contact, and shipping information. Please review your order carefully before submitting it.

6. Pricing, Payments, and Taxes

Prices are displayed in the currency shown at checkout and may change without notice. The price charged will be the price displayed when your order is submitted, except where an obvious error has occurred.

Applicable taxes, shipping fees, duties, and other charges will be displayed or calculated when available. International customers may be responsible for customs duties, import taxes, brokerage charges, or other fees imposed by local authorities.

By providing a payment method, you represent that:

• You are authorized to use that payment method

• The information provided is accurate

• You authorize us and our payment processors to charge the total amount shown at checkout

Payments are processed by Shopify and other authorized payment providers. We do not guarantee that every payment method will always be available.

Promotional codes, discounts, and special offers may be subject to separate terms. Unless expressly stated otherwise, promotions cannot be combined, transferred, redeemed for cash, or applied retroactively.

7. Subscriptions and Recurring Charges

When you purchase a subscription, you authorize us to charge your selected payment method automatically at the price and frequency disclosed at checkout until the subscription is canceled.

Before completing a subscription purchase, you will be shown material subscription terms, including the recurring price and delivery frequency. By completing the purchase, you consent to recurring charges according to those terms.

You are responsible for maintaining accurate payment, billing, shipping, and account information. If a payment cannot be processed, we may retry the charge, request an updated payment method, pause the subscription, or cancel it.

You may manage or cancel your subscription through the customer portal or by contacting us at support@themodernformula.shop. Cancellation must be completed before the next scheduled billing date to prevent the next recurring charge.

Canceling a subscription prevents future recurring charges. It does not automatically cancel or refund an order that has already been billed or entered fulfillment, except where required by law or permitted under our Return and Refund Policy.

We may change subscription pricing or other material subscription terms by providing advance notice as required by applicable law. You may cancel before the change takes effect.

8. Shipping and Delivery

We use third-party fulfillment providers and shipping carriers to store, pack, and deliver orders.

Processing and delivery dates are estimates, not guarantees. Delivery may be affected by carrier operations, customs processing, weather, holidays, incorrect addresses, high order volume, or events outside our reasonable control.

Ownership, risk of loss, and responsibility for an order will transfer as provided by applicable law. Nothing in these Terms removes rights that cannot legally be waived.

If we cannot ship within the timeframe stated at purchase, we will provide any notice, cancellation option, or refund required by applicable law.

Shipping concerns are governed by our Shipping Policy. Damaged, defective, incorrect, or missing items are governed by our Return and Refund Policy.

9. Returns, Refunds, and Quality Guarantee

Returns, replacements, and refunds are governed by our Return and Refund Policy.

Because we sell consumable products, general returns and exchanges may not be accepted after an order ships. Our 30-Day Quality Guarantee applies to qualifying products that arrive damaged or defective, subject to the requirements in the Return and Refund Policy.

The 30-Day Quality Guarantee is not a general satisfaction or results-based money-back guarantee.

Nothing in these Terms limits any consumer right or remedy that cannot legally be excluded.

10. Accounts and Account Security

You may be able to create a customer account to manage orders, subscriptions, addresses, and preferences.

You are responsible for:

• Providing accurate account information

• Keeping your login credentials confidential

• Restricting access to your account and devices

• Notifying us promptly of suspected unauthorized access

We may suspend or terminate an account if we reasonably believe it has been compromised, used fraudulently, or used in violation of these Terms.

11. Intellectual Property

All website content, including our brand name, trademarks, logos, product names, packaging designs, graphics, photographs, videos, text, website layout, and other materials, is owned by or licensed to Rizq Ventures LLC and is protected by applicable intellectual-property laws.

We grant you a limited, personal, non-exclusive, non-transferable, and revocable right to access and use the website for lawful personal shopping purposes.

You may not, without prior written permission:

• It is accurate based on your genuine experience

• You have disclosed any material relationship or incentive connected to the submission

You grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, display, adapt, publish, and distribute submitted content for operating, improving, and promoting our business, subject to applicable law and our Privacy Policy.

We may review, refuse, or remove user content that violates these Terms, but we are not required to monitor every submission.

13. Prohibited Conduct

You may not:

• Use the Services for unlawful, fraudulent, or abusive purposes

• Interfere with the website’s operation or security

• Introduce viruses, malicious code, or harmful technologies

• Attempt unauthorized access to accounts, systems, or data

By using the Services, you acknowledge that personal information may be processed by Shopify and other service providers as described in that policy.

16. Errors and Corrections

The website may occasionally contain typographical errors, inaccuracies, omissions, or outdated information concerning product descriptions, pricing, promotions, availability, shipping, or other matters.

We may correct errors and update information at any time. If an error materially affects an order you placed, we may contact you for instructions or cancel and refund the affected order, subject to applicable law.

We do not warrant that:

Where liability can lawfully be limited, our total liability arising from an order will not exceed the amount you paid for the product or order giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited or excluded, including liability arising from fraud, willful misconduct, gross negligence, or certain personal injuries where applicable law prohibits exclusion.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold Rizq Ventures LLC harmless from third-party claims, losses, liabilities, and reasonable expenses arising from:

• Your unlawful misuse of the website or Services

• Your violation of these Terms

• Your infringement of another person’s rights

• Content you submit through the Services

This section does not require you to indemnify us for our own unlawful conduct, negligence, or breach of these Terms.

We are not responsible for delays or failures caused by events outside our reasonable control, including natural disasters, severe weather, labor disruptions, carrier interruptions, customs delays, governmental actions, public-health emergencies, power failures, cyberattacks, or interruptions affecting third-party services.

This section does not limit any refund, cancellation, or other right that applicable law requires us to provide.

We may suspend or terminate your access to the Services if you violate these Terms, misuse the website, engage in fraudulent activity, or create a security or legal risk.

Sections that by their nature should survive termination will remain effective, including provisions concerning intellectual property, disclaimers, liability, indemnification, and disputes.

22. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.

Before filing a legal claim, you and The Modern Formula agree to make a reasonable good-faith effort to resolve the dispute by contacting the other party and allowing 30 days for a response. This requirement does not prevent either party from seeking urgent relief or exercising a right that cannot legally be restricted.

Any dispute that cannot be resolved informally may be brought before a court with lawful jurisdiction in Pennsylvania, except where applicable consumer law gives you the right to bring a claim in another location.

Nothing in these Terms limits mandatory consumer rights or legal protections available in your place of residence.

23. Severability

If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or removed to the minimum extent necessary. The remaining provisions will continue in effect.

24. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision later.

25. Entire Agreement

These Terms and the policies referenced in them constitute the entire agreement between you and Rizq Ventures LLC regarding the Services and replace prior agreements concerning the same subject matter.

26. Changes to These Terms

We may update these Terms to reflect changes to our Services, business practices, or legal obligations.

The revised Terms will be posted on this page with an updated revision date. Where required by law, we will provide additional notice before material changes take effect.

Changes will not retroactively reduce rights relating to an order already completed unless permitted by law.
